This Privacy Policy (“Policy”) describes how Homelike Internet GmbH and its affiliates (“we,” “us,” or “Homelike”), collect, use, and share personal information through our  website at www.thehomelike.com (our “Site”), social media pages, any applications that we may make available, including mobile applications, and any websites, offerings, products, or services that link to this Policy (collectively, the “Platform”).   Please read this Policy carefully before using the Platform.

By accessing the Platform, you agree to be bound by this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use the Platform. Each time you use the Platform, the current version of this Privacy Policy will apply. Accordingly, when you use the Platform, you should check the date of this Privacy Policy (which appears at the top) and review any changes since you last reviewed the Privacy Policy. Undefined terms in this Privacy Policy have the same definition as in our Terms of Service (“Terms”).

1. INFORMATION WE COLLECT

We collect two types of information from Users of our Platform: “Personal Information,” which is information that you provide that can be used to identify you (such as your name, email address, etc.), and “Aggregate Information,” which is information that cannot be used to identify you (such as frequency of visits to the Site, browser type, etc.).

1.1 Information You Provide to Us:

We collect Personal Information that you voluntarily provide to us when you use our Platform. For example, you may provide us with your contact information such as your email address, first name and last name, phone number, company name, or other Personal Information when you choose to submit such information to us through email, an online form, or other method (such as contacting us through our “Support” Site feature).

1.2 User Profiles And Accommodations:

  • If you create an account on our Platform or use our Platform to offer or to book reservations, we collect Personal Information and other information from you as necessary to facilitate your requests. If you create an account or book a reservation, we collect certain Personal Information from you such as your name, address, email address, account login information, and company name. 
  • You may also provide additional optional Personal Information to us, such as your telephone number, professional information (employer, position, salary, education, certificates, and additional qualifications), photo, date of birth, and nationality. 
  • For some reservations, you may be required to create a digital signature.  In such cases, the digital signature may be shared with other Users with whom you are booking a reservation.

1.3 Payment Information:

We use Stripe, a third party payment processor, to process credit and debit card payments.  Your full credit and debit card information is never shared with us, and at no point in any transaction do we have access to that information.  You should consult Stripe’s privacy Policy and terms of use to learn more about how it processes credit and debit card transactions for us by visiting https://stripe.com/privacy.

1.4 Social Media And Third-Party Accounts:

If you link your account on the Platform to your account on a third-party website, such as a social media website, we may receive Personal Information about you from your account with such third-party website.

1.5 Information We Automatically Collect:

When you use our Platform we automatically receive and collect information about you and your device.  This information includes the following: 

  • Information about your device, such as the operating system, hardware, system version, Internet Protocol (IP) address, device ID, and device language.
  • The specific actions that you take when you use our Platform, including but not limited to the pages and screens that you view or visit, search terms that you enter, and how you interact with our Platform.
  • The time, frequency, connection type, and duration of your use of our Platform.
  • Information regarding your interaction with email messages, for example, whether you opened, clicked on, or forwarded the email message.
  • Identifiers associated with cookies or other technologies that may uniquely identify your device or browser (as further described below).
  • Pages you visited before or after navigating to our Site.

1.6 Careers:

If you apply for a position with us through our “jobs” page, we will collect your application information and may use it to evaluate your candidacy.

1.7 SMS Messages:

If you opt-in, we may contact you at the mobile number that you provide to us by way or direct dial calls, autodialed and prerecorded message calls, and automated text messages to send you information about booking and reservation confirmations and updates, receipts, technical notices, updates, security alerts, and support and administrative messages.  If you no longer want to receive text message from us, reply STOP (or as otherwise instructed) to the text message.  You may also opt-out of receiving text messages from us through your account settings.

1.8 Collection Of Personal Information By Third Parties:

Some links on our Platform may redirect you to third-party websites that we do not operate, which may include social media features, such as LinkedIn buttons or links. The privacy practices of those websites will be governed by their own policies. We make no representation or warranty as to the privacy practices or policies of any third parties, including the providers of third-party applications. If you are submitting information to any such third-party through our Platform, you should review and understand that party’s applicable policies, including their privacy policies, before providing your information to the third-party.

1.9 Aggregate Information Collected:

Aggregate Information is information that does not identify you. Aggregate Information may be collected when you use our Platform, independent of any information you voluntarily enter. Additionally, we may use one or more processes to de-identify information that contains Personal Information, such that only Aggregate Information remains. We may collect, use, store, and transfer Aggregate Information without restriction.

2. COOKIES AND ANALYTICS:

2.1 Cookies:

Like most websites, our Site and Platform use “cookies.” Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser to help us identify you when you come to our Platform. You have choices with respect to cookies. By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose to reject all cookies you may be unable to use those aspects of our Platform that require registration in order to participate. Doing so, however, may disable certain features on our Platform. You can opt-out from third-party cookies that are used for advertising purposes on the NAI website.

2.2 Analytics:

We may also use third parties, such as Google Analytics, to analyze traffic to the Platform.  Google Analytics does not create individual profiles for visitors and only collects aggregate data.  To disable Google Analytics, please download the browser add-on for the deactivation of Google Analytics provided by Google at http://tools.google.com/dlpage/gaoptout?hl=en.  To learn more about privacy and Google Analytics, please consult the Google Analytics overview provided by Google at http://www.google.com/intl/en/analytics/privacyoverview.html.  You may find additional information about Google Analytics at http://www.google.com/policies/privacy/partners/.  You have the option to opt out of Google’s use of cookies by changing your settings through Google Ad Settings via the Google advertising opt-out page at http://www.google.com/policies/technologies/ads/.

2.3 Interest-Based Advertising:

We may also participate in interest-based advertising using similar technology to cookies and analytics. This means that you may see advertising on our Sites tailored to how you browse or shop, or you may see advertising for Homelike and its services and accommodations on other websites based on your browsing behavior across websites. Some websites where we may advertise belong to ad networks that use your web browsing history to choose which ads to display on their network websites; these ads include advertising for Homelike and its Sites, but no Personal Information about you is shared with those third party ad networks. Other websites where you see our ads, such as Facebook, may use interest preferences that you have chosen on those sites, as well as registration and other information about you, to choose which ads to display to you. Some internet browsers, websites such as Facebook and mobile devices offer opt-outs for interest-based advertising. Please refer to the website that you are visiting, your browser and/or your device settings for additional information.  

 

You can opt-out of receiving interest-based ads from third parties who are members of the Network Advertising Initiative (NAI) or who follow the Digital Advertising Alliance’s Self-Regulatory Principles for Online Behavioral Advertising by visiting the opt-out pages on the NAI website (http://www.networkadvertising.org/choices/) and DAA website (http://www.aboutads.info/choices/).

 

We may also use cookies, pixels, beacons, or other web tracking technologies to track the amount of time spent on our Platform and whether or not certain content, was viewed. We may work with a trusted third party to collect and process this information for us, based on our instructions and in compliance with this Policy.

 

Although we do our best to honor the privacy preferences of our visitors, we are not able to respond to Do Not Track signals from your browser.

3. HOW WE USE YOUR INFORMATION

In general, we collect information and Personal Information from you so that we can provide our Platform, operate our business, and provide information that you request from us. This includes the following uses and purposes: Provide, operate, improve, maintain, and protect our Platform.

  • Send you updates, marketing communication, and other information about Homelike and our Platform. 
  • Send you push notifications.
  • Conduct research and analysis, and monitor and analyze trends and usage.
  • Enhance or improve User experience, our business, and our Platform, including the safety and security thereof.  
  • Personalize our Platform to you. 
  • Communicate with you and respond to inquiries.
  • Consider your application for employment.
  • As necessary to comply with any applicable law, regulation, subpoena, legal process, or governmental request.
  • Enforce our Terms, contracts, including investigation of potential violations thereof.
  • Detect, prevent, or otherwise address fraud, security or technical issues.
  • Protect against harm to the rights, property or safety of Homelike, our Users, or the public as required or permitted by law.

3.1 Bookings and Reservations:

We may use your information, including your Personal Information, as necessary to complete bookings and reservations.

4. HOW WE SHARE YOUR INFORMATION

Like most companies, we share information, including Personal Information, in certain circumstances with our affiliate companies and with third parties through operation of our Platform and our business.  Below we explain when that happens.  Note that we do not rent or sell your Personal Information.

4.1 Other Users:

If you submit a booking request, your account information, including some of your Personal Information, is shared with the accommodation provider. Your account information is not shared with other Users or the public in such situations. 

 

Your contact details (such as your name, email address, and, where applicable, telephone number) are only exchanged with other Users once a binding booking or reservation has been made with that User.

 

If you use any chat or communication function on our Platform, your account information, including some of your Personal Information, and the message content that you enter will be shared with User(s) that you communicate with. 

 

We prohibit Users from using Personal Information obtained through the Platform for any purposes other than contractual communication regarding accommodations, but we cannot and do not take responsibility for Users’ use of any information, including Personal Information, that they obtain through the Platform. Keep in mind that Users that you communicate with may, in some cases, be able to save that content or copy it outside of our Platform, so do not send messages or share content that you would not want another User to save or share.

4.2 Service Providers:

We may transfer Personal Information to third parties for the purpose of providing the Platform or operating our business. For example, we may transfer your Personal Information to third-party service providers to assist with providing the Platform and other services, and to communicate with you about current or future offerings.

4.3 Required Transfers:

We may also transfer your Personal Information to third parties under the following circumstances: (i) to comply with a legal requirement, law, subpoena, judicial proceeding, court order, governmental request, or legal process; (ii) to investigate a possible crime, such as fraud or identity theft; (iii) in connection with the sale, purchase, merger, asset sale, financing, reorganization, liquidation or dissolution of Homelike; (iv) when we believe it is necessary to protect the rights, property, or safety of Homelike or other persons, or (v) as otherwise required or permitted by law, including any contractual obligations of Homelike.

4.4 As Directed By You And With Your Consent:

Except as otherwise provided in this Privacy Policy, we share Personal Information with companies, organizations or individuals outside of Homelike only at your direction or when we have your consent to do so.

5. YOUR PRIVACY CHOICES

5.1 Privacy Choices:

You can view, modify, and delete most of the Personal Information in your User account at any time. You can also delete your User account. If you would like to modify or access additional information that is not available through the Platform, please contact us at usdata@homelike.cc.  We may ask you to verify your identify or provide additional information before we act on your request.  We may reject or deny requests for certain reasons, such as when we believe a request is fraudulent. In some cases, we may not be able to delete some or all of your Personal Information, such as, for example, if you have a booking, or if we are required to retain such information to comply with our record-keeping obligations. 

 

If you no longer wish to receive our marketing and promotional communications, you may opt-out or unsubscribe by following the instructions included in each communication.

6. SECURITY

We take the security of your Personal Information very seriously. We use reasonable administrative, physical, and technical safeguards to secure the Personal Information you share with us. Despite these safeguards and our additional efforts to secure your information, we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your Personal Information.

7. CHILDREN

Our Platform are not intended to be used by children under the age of 13, and we do not knowingly collect Personal Information from children under the age of 13 in connection with the Platform.

8. CHANGES TO THIS POLICY

Each time you use our Platform the current version of this Privacy Policy will apply. When you use our Platform, you should check the date of this Privacy Policy (which appears at the top of the Privacy Policy) and review any changes since the last version. Our business changes frequently and this Privacy Policy is subject to change from time to time.
